1. Acceptance of Terms
By downloading, accessing, or using the SmaarT HR application ("the App"), you agree to be bound by these Terms and Conditions.
If you do not agree, please do not use the App.
2. Description of Service
SmaarT HR is an internal HR management tool designed to help organizations record employee attendance via geo-location, face detection, or NFC card verification and manage payroll.
3. User Accounts
Access to the App is limited to authorized employees and administrators of participating organizations.
You are responsible for maintaining the confidentiality of your login credentials and for all activity under your account.
4. Authorized Use
You agree to use the App only for lawful HR purposes within your organization.
You must not:
- Access or attempt to access another user's data without authorization
- Copy, modify, or distribute any part of the App without written consent
- Use the App in any manner that could damage, disable, or impair the system
5. Data and Privacy
Use of the App is also governed by our Privacy Policy.
By using SmaarT HR, you consent to the collection and use of your information as described there.
6. Intellectual Property
All rights, title, and interest in SmaarT HR—including trademarks, logos, software code, and designs—are the exclusive property of ProcessSmaart Private Limited.
You may not copy, reverse-engineer, or redistribute the App without prior written consent.
7. Termination of Access
We reserve the right to suspend or terminate user accounts that violate these Terms, compromise system security, or misuse the App.
Organizations may also manage user access independently.
8. Disclaimer of Warranties
SmaarT HR is provided on an "as is" and "as available" basis.
ProcessSmaart Private Limited makes no warranties, express or implied, regarding the App's performance, accuracy, or availability.
9. Limitation of Liability
To the maximum extent permitted by applicable law, ProcessSmaart Private Limited shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, goodwill, or business interruption, arising out of or in connection with the use or inability to use the App, whether based on contract, tort (including negligence), strict liability, or otherwise.
In no event shall ProcessSmaart Private Limited's total liability for any claim arising out of or relating to the App exceed the total amount paid by the user for use of the App during the twelve (12) months preceding the event giving rise to such claim.
10. Governing Law and Jurisdiction
These Terms shall be governed by and construed in accordance with the laws of India.
Any disputes shall be subject to the exclusive jurisdiction of the courts in Kochi, India.
11. Amendments
We may modify these Terms from time to time. Updated versions will be posted on https://processsmaart.com/terms with a revised Effective Date.
